By using the productlensai.com (and productlens.ai) website or product (“Services”), including but not limited to creating assets (“Content”), you are agreeing to be bound by the following terms and conditions (“Terms of Service”). If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity, its affiliates and all users who access our services through your account to these terms and conditions, in which case the terms “you” or “your” shall refer to such entity, its affiliates and users associated with it. If you do not have such authority, or if you do not agree with these terms and conditions, you must not accept this agreement and may not use the services.

“The Site” refers to the websites operated by Product Lens AI, including but not limited to productlensai.com and productlens.ai, as well as any associated applications, services, features, content, and functionalities offered by The Site.

Product Lens AI reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Services, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Services after any such changes shall constitute your consent to such changes. Violation of any of the terms below will result in the termination of your Account. While The Site prohibits such conduct and Content on the Services, you understand and agree that The Site cannot be responsible for the Content posted on the Services and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.

Account Terms

You must be 16 years or older to use the Services. You are responsible for maintaining the security of your account and password. The Site cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account). Each person must have a unique account and you are responsible for any activity conducted on your account. A breach or violation of any of our Terms of Service may result in an immediate termination of your right to use our Service. You may not use the Services for any illegal or unauthorized purpose. You must not, in the use of the Services, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws). You agree to not create Content that:

You agree to only use the Services for positive and lawful purposes, such as but not limited to:

1. Creating advertisements for legitimate products and services
2. Marketing campaigns that promote legal and ethical businesses
3. Educational content for personal or commercial use
4. Any other purpose that complies with applicable laws and this TOS.

Content Terms

You own the images you generate and can use them however you want. There is no assurance or guarantee that the images do not violate the intellectual property rights of others. You are solely responsible for assessing whether The Site and the images are appropriate for your needs. You assume all risks associated with using the images.

Content Licence

Subject to your compliance with this Agreement, the conditions herein and any limitations applicable to The Site or by law: (i) you are granted a non-exclusive, limited, non-transferable, non-sublicensable, non-assignable, freely revocable license to access and use the Service for business or personal use; (ii) you own all Content you create with the Services and (iii) we hereby assign to you all rights, title and interest in and to such Content for your personal or commercial use. Otherwise, The Site reserves all rights not expressly granted under these Terms of Service.

Payment and Billing

When you make a purchase, you acknowledge the suitability of the Services and waive your right to withdraw your purchase and request for refunds. If you have not generated any images yet, email us to apply for a refund. You can cancel your subscription anytime in your account under Profile > Manage Billing. If you do not cancel your subscription before the renewal, you will be charged the price for the subscription renewal. The subscription renewal charge is non-refundable.

Links to other websites

You may gain access to other websites via links on The Site. These Terms apply to The Site only and do not apply to other parties’ websites. Similarly, you may have come to the Site via a link from another website. The terms of service of other websites do not apply to The Site.

The Site assumes no responsibility for any terms of service or material outside of the Site accessed via any link. You are free to establish a hypertext link to the Site so long as the link does not state or imply any sponsorship of your website or service by The Site. Unless expressly agreed to by us in writing, reference to any of our products, services, processes or other information by trade name, trademark, logo, or otherwise by you or any third party does not constitute or imply endorsement, sponsorship or recommendation thereof by us. You may not, without our prior written permission, frame or inline link any of the content of the Site, scrape the Site or incorporate into another website or other service any of our material, content or intellectual property unless you are otherwise permitted by us to do so in accordance with a license or subject to separate terms.

Limitation of liability

Except as prohibited by law, if there is liability found on the part of the Company, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. Some states do not allow the exclusion or limitation of punitive, incidental or consequential damages, so the prior limitation or exclusion may not apply to you.

Termination

We may terminate or suspend your account and bar access to Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Changes to Services

At its sole discretion, The Site may modify or replace any of the Terms of Service, or change, suspend, or discontinue the Service (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on The Site or Service or by sending you an email.
